1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Crackers Makers® website and services, operated by Yugan Enterprises. By browsing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please discontinue use of the website.

2. Nature of Our Service — Sales Aggregator

Crackers Makers® operates as a sales aggregator / retailer platform for fireworks and celebration products sourced from licensed manufacturers and suppliers. We are not the manufacturer of the fireworks listed on our platform. We facilitate discovery, ordering, payment, and delivery/pickup coordination of products on behalf of the manufacturers/suppliers we work with.

3. Eligibility & Age Restriction

  1. You must be at least 18 years of age to create an account, place an order, or purchase fireworks through our platform.

  2. By placing an order, you represent and warrant that you are legally eligible to purchase, possess, and use fireworks in your state/jurisdiction.

  3. We reserve the right to refuse, cancel, or delay any order where age or eligibility cannot be reasonably verified.

4. Regulatory Compliance & Licensing

Fireworks are regulated products in India. We source products only from suppliers/manufacturers who represent that they hold valid licenses under applicable explosives and fireworks regulations (including licenses issued under the Explosives Act/Rules, as applicable, and any state or local fire-safety requirements). Customers are solely responsible for:

  • Complying with all local, state, and national laws, rules, and time restrictions (including any bans, curfew hours, or designated-zone requirements) governing the purchase, storage, transport, and bursting of fireworks in their area.

  • Obtaining any permits or permissions required in their locality prior to use.

  • Verifying that the quantity and type of product ordered complies with local possession limits.

5. Assumption of Risk & Limitation of Liability

Fireworks are inherently hazardous products. By purchasing from Crackers Makers®, you acknowledge and agree that:

  1. You are solely responsible for the safe handling, storage, transport, use, and disposal of all fireworks purchased through our platform.

  2. Crackers Makers®, Yugan Enterprises, its owners, employees, and representatives shall not be held responsible or liable for any injury, death, property damage, fire, environmental harm, or other loss or incident arising from the purchase, storage, handling, or use of fireworks bought through our platform, whether such use is by the purchaser or any third party.

  3. You are responsible for following all safety instructions provided by the manufacturer on product packaging, and for ensuring fireworks are kept out of reach of children and used only by, or under the direct supervision of, a responsible adult.

  4. We are not liable for any illegal, negligent, reckless, or improper use of fireworks purchased through our platform, and you agree to indemnify and hold us harmless from any claims, damages, fines, or legal proceedings arising from such use.

  5. To the maximum extent permitted by law, our total liability for any claim arising from your order shall not exceed the amount paid by you for the specific product(s) giving rise to the claim.

  6. We are not liable for delays, losses, or damages caused by third-party courier/logistics partners once goods are handed over for delivery, though we will reasonably assist in resolving such issues on your behalf.

6. Orders, Pricing & Payment

  • All prices are listed in Indian Rupees (INR) and are subject to change without prior notice until an order is confirmed.

  • Orders are confirmed only upon successful payment through our online payment gateway partner (e.g. Razorpay).

  • We reserve the right to cancel any order due to product unavailability, pricing errors, suspected fraud, or failure to verify age/eligibility, in which case a full refund will be issued.

7. Delivery & Pickup

  • Orders may be fulfilled by courier delivery or in-store/local pickup, as selected at checkout and subject to product/location availability.

  • Estimated delivery timelines are indicative and not guaranteed; delays caused by courier partners, regulatory checks, weather, or events beyond our control are outside our responsibility.

  • For pickup orders, valid ID and, where applicable, age verification may be required at the time of collection.

8. Coupons, Discounts & Loyalty Program

Any coupon, discount, or Sparkverse™ loyalty benefit is subject to its own specific terms, validity period, and usage limits, and may be modified, restricted, or withdrawn at our discretion to prevent abuse or misuse.

9. Intellectual Property

All trademarks, logos (including Crackers Makers®, Sparko™, and Sparkverse™), content, and designs on our website are the property of Yugan Enterprises or its licensors and may not be copied, reproduced, or used without prior written permission.

10. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, fire, government restrictions or bans on fireworks sale/transport, strikes, courier disruptions, or public health emergencies.

11. Termination of Access

We reserve the right to suspend or terminate your access to our website or services at our discretion, including where we suspect fraudulent activity, misuse of our platform, or violation of these Terms.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Virudhunagar, Tamil Nadu, India.

13. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted on our website with a revised Effective Date, and continued use of our website constitutes acceptance of the revised Terms.
